Firm Obtains Unanimous Jury Verdict for Defendant in Employment Discrimination Case

Tredway, Lumsdaine & Doyle LLP Partner Shannon Marie Jenkins and Associate Ryan P. Murray obtained a unanimous jury verdict for the Firm’s client after a week long trial in Orange County Superior Court.  TL&D provided a defense for the defendant corporation accused of discrimination and wrongful termination on the basis of age and disability.  The plaintiff, a software engineer, was seeking punitive damages as well as damages for pain and suffering and hundreds of thousands of dollars in lost wages. 

The plaintiff had accused his former employer of refusing to accommodate his disabilities and for terminating him either because of his age or disabled status.  The defendant asserted that it had terminated the plaintiff because of his poor performance and multiple misrepresentations to his superiors regarding his completion of assignments. 

 During trial, Ms. Jenkins and Mr. Murray employed state of the art trial tactics including audiovisual demonstrations to narrow the jury’s focus to the most relevant issues.  Through this laser-like precision, Ms. Jenkins and Mr. Murray were able to reduce the plaintiff’s claims from seven causes of action to two.  Ultimately, the jury was asked two simple “yes” or “no” questions:  “Was the plaintiff terminated because of his disabilities” and “Was the plaintiff terminated because of his age.”  After having heard Ms. Jenkins’ closing arguments, which included a highly effective multimedia presentation developed by Mr. Murray, the jury knew the correct answer to both questions was “no.”  The jurors therefore found completely in favor of the defendant, awarding no damages to the plaintiff whatsoever.

Firm’s Commitment to ARC Celebrated

On April 14, 2011, Tredway, Lumsdaine & Doyle, LLP and The Arc celebrated their decade long joint collaboration in an evening of fun and fellowship at the Reagan Banquet and Conference Center in Downey. This year TL&D is celebrating 50 years of legal service to the clients and communities of Southern California.

Tredway Lumsdaine & Doyle has historically supported The Arc of Los Angeles and Orange County. The organization provides a wide range of services to individuals with intellectual and developmental disabilities by employing Arc-trained and supported individuals with developmental disabilities, by legal representation of the Arc, by support of Arc’s annual Walk for Independence, and by attorneys from the firm serving on the board for the non-profit organization.

To continue its history together, Tredway, Lumsdaine & Doyle has recently pledged to provide guidance and assistance to The Arc’s Center for Human Rights. The Center provides its consumers and their families with information on various services such as regional centers, adult protection, individual education plans, rehabilita-tion, housing/placement, employment and several other areas. This collaboration between the public and private sectors has included multiple Tredway, Lumsdaine & Doyle associates serving on The Arc’s Board of Directors, pro bono representation and 15 years of participation and sponsorship of The Arc’s annual Walk for Independence. Tredway, Lumsdaine & Doyle can also credit its success to its administrative team which has hired someone with a developmental disability consistently over the past 20 years.

The firm also presented The Arc with a check for $2,500 for its many activities facilitating the disabled. Kevin MacDonald, Executive Director of The Arc, praised the relationship between the firm and the Arc: “We look forward to your next 50 years with a renewed partnership in the area of employment for people with disabilities and with The Arc Center for Human Rights…we thank you for being such an outstanding partner because of the caring attitude that comes out of every area of your firm.”

In attendance at the firm’s anniversary celebration were many of TLD’s attorneys and associates, members of The Arc organization, and a number of community leaders, including Downey City Councilman, Dave Gafin and Arc President, Raul Lopez. “We are committed to helping the ARC in the future”, said Matthew Kinley, managing partner of TLD. “We are also committed to help The Arc find businesses that will employ the disabled. They are committed to their jobs and makes good business sense to help the community.”
